Tuberville Sponsors Resolution to Overturn Biden’s Attack on Title IX, Save Women’s Sports

WASHINGTON – Today, U.S. Senator Tommy Tuberville (R-AL) joined Cindy Hyde-Smith (R-MS) and 32 Senate colleagues in introducing a Congressional Review Act (CRA) resolution of disapproval to protect Title IX and save women’s sports. The resolution, if passed, would overturn the Biden Department of Education’s final rule that requires schools to allow biological men who identify as “female” to use bathrooms, locker rooms, or any other spaces intended for biological women and girls. This woke Title IX rewrite redefines gender and has the potential to impact women’s sports. Sen. Tuberville joined Sen. Hyde-Smith and several of their colleagues for a press conference today discussing the importance of preserving Title IX.

“I spent my career dealing with athletes—men and women—and promoting fair opportunity to achieve in the classroom and the playing field,” said Senator Tuberville.“The Democrats don’t care about family, faith, or gender. This is about being fair—there is no reason to subject young girls to this. It’s wrong and we’re going to fight it until the end. There is nothing more important than the kids in this country.”

BACKGROUND

As a former educator, mentor, and coach for more than 40 years, Senator Tuberville is concerned about the future of girls’ and women’s sports. He began his career coaching high school girls’ basketball shortly after the enactment of Title IX and witnessed the law’s positive impacts firsthand. Senator Tuberville has been a vocal advocate of preserving Title IX and urged Joe Biden’s Department of Education officials to keep the protections in place. 

In June 2022, on the 50th anniversary of Title IX’s enactment, the Education Department issued a proposed rule to allow biological males to compete in women’s sports. Sen. Tuberville urged Joe Biden’s Education Department officials to keep the protections in place and cited his concern about the negative implications it would have for female athletes.

Despite receiving nearly 240,000 comments in opposition to the proposed rule, the Education Department ignored every single one and published the final Title IX rule in April 2024. This is not the expected sports rule—the Education Department is working on a separate effort to allow biological men to compete in women’s sports. Sen. Tuberville issued a scathing statement in response to the final rule and pledged to oppose it.

Broadly, opposition to the final Title IX regulation is targeted at the Education Department importing Sexual Orientation and Gender Identity (SOGI) protections into Title IX, extending protections to gender identity and sexual orientation. This radical shift, which essentially legislates through regulation, could allow biological males who identify as females to compete in women’s and girls’ sports. Further, noncompliance with Title IX regulations jeopardizes all federal funds an institution receives.
